Please read these Terms and Conditions of Service ("Terms") carefully before booking or participating in any coaching services provided by Surfskate Noosa ("we", "us", or "our"). These Terms govern your use of our website at https://www.surfskatenoosa.com/ and your engagement with our coaching programs and related services (collectively, the "Service").

By making a booking, completing a registration form, or participating in any session, you agree to be bound by these Terms. If you are booking on behalf of a minor participant, you confirm that you are the parent or legal guardian of that participant and that you accept these Terms on their behalf.

1. Services

Surfskate Noosa provides ocean-based surf coaching, land-based surfskate coaching, and related performance development services ("Coaching Services") as described on our website. We also offer adaptive and para-surf coaching for participants with disabilities. Specific program inclusions, session duration, and any additional requirements will be communicated at the time of booking or as part of the program description.

2. Booking and Payment

2a. Bookings

All bookings for Coaching Services must be made via our online booking system at https://www.surfskatenoosa.com/ or by contacting us directly. A booking is confirmed only upon receipt of full payment or written confirmation from Surfskate Noosa.

2b. Payment

Fees for Coaching Services are due in full at the time of booking. We accept payment by credit card, bank transfer, and cash (for in-person arrangements). Details of accepted payment methods will be confirmed at the time of booking.

2c. Pricing

All prices are listed on our website and are subject to change. Any change to pricing will not affect confirmed bookings — the price agreed at the time of booking will be honoured.

3. Cancellations and Refunds

3a. Client Cancellation

If you need to cancel a booked session, please notify us as soon as possible. The following policy applies:

  • Cancellations made more than 24 hours before the scheduled session: full refund or session credit at your election.
  • Cancellations made within 24 hours of the scheduled session: the full session fee may be forfeited, except where exceptional circumstances apply.

3b. Surfskate Noosa Cancellation

We reserve the right to cancel or postpone a session due to unsafe weather or surf conditions, coach illness or injury, or other unforeseen circumstances beyond our control. Where we cancel a session, you will be offered either a full refund or the opportunity to reschedule at no additional cost.

Note on Australian Consumer Law: Our cancellation and refund policy operates in addition to any rights you may have under the Australian Consumer Law (ACL).

4. Assumption of Risk and Limitation of Liability

4a. Acknowledgment of Risk

Surf and surfskate coaching are physical activities that carry inherent risks. These may include:

  • Physical injury, ranging from minor to severe
  • Contact with ocean environments including waves, currents, marine life, and submerged objects
  • Collision with other participants, coaches, surfboards, or skate equipment
  • Falls on uneven or hard surfaces
  • Equipment malfunction
  • In extreme and rare cases, death

4b. Voluntary Assumption of Risk

You confirm that participation is voluntary and that you accept all inherent risks associated with surf and surfskate activities.

4c. Health and Fitness Declaration

By booking and participating, you confirm that you (or the minor participant) are in a suitable physical condition to participate safely. Any relevant medical conditions must be disclosed prior to participation.

4d. Limitation of Liability

To the maximum extent permitted by law, Surfskate Noosa and its representatives will not be liable for any loss, damage, or injury arising from participation in the Coaching Services.

Important: Nothing in these Terms excludes rights under the Australian Consumer Law.

5. Minor Participants

If a participant is under 18 years of age, a parent or legal guardian must:

  • Accept these Terms on the minor's behalf
  • Complete required consent and waiver forms
  • Disclose relevant medical or health information

The parent or guardian accepts responsibility for the minor's safety and conduct during sessions.

6. Photography, Video, and Media

We may capture photographs and video footage during coaching sessions for use in marketing and promotional materials.

If you do not consent, please notify us in writing before your session.

7. Participant Conduct

All participants are expected to:

  • Follow instructions from coaches
  • Behave respectfully toward others
  • Use equipment safely
  • Report any injury or discomfort immediately

We reserve the right to remove participants from sessions without refund if safety is compromised.

8. Intellectual Property

All content, coaching methodologies, and materials are the intellectual property of Surfskate Noosa and may not be reproduced without permission.

9. Privacy

Your personal information is handled in accordance with our Privacy Policy, available on our website.

10. Dispute Resolution

If you have a concern, please contact us first so we can attempt to resolve it. If unresolved, parties agree to mediation before legal proceedings.

These Terms are governed by the laws of Queensland, Australia.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our services constitutes acceptance of any updates.

12. Severability

If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
